Any logo, brand, sign, product name, title, graphic, video, user interface, visual interface, source code (hereinafter the "Contents") including, and without this list being exhaustive, the operation and appearance of these Contents, appearing on the website are the property of SARL L'Agri O Conso in its entirety, as well as all the rights relating thereto. Any reproduction, in whole or in part, is systematically subject to the authorisation of the owners.

These general conditions of sale (hereinafter the "Conditions of Sale") apply to all Internet users who place orders for products through the Site.

They are intended to define the conditions under which the sales contract is concluded between L'Agri O Conso and each of its customers placing orders through the Site (hereinafter "the Customer").

1. Acceptance of Terms

The customer acknowledges having read, at the time of placing the order, the Terms & Conditions of sale set out on this screen and expressly declares to accept them without reservation.
These general conditions of sale govern the contractual relationship between L'Agri O Conso and its customer, both parties accepting them without reservation. These general conditions of sale will prevail over all other conditions appearing in any other document, except prior, express and written derogation.

2. Products

The photographs illustrate the products but remain non-contractual. The products delivered to you comply with the norms in place. The products in sale come from Guadeloupe.

3. Order

To place an order, the Customer must have the legal capacity to contract, that is to say be of legal majority and not be under guardianship or curatorship.

Any order implies express and irrevocable acceptance of the prices and descriptions of the Products available for sale.
The Customer declares before placing his order to have read and irrevocably accepted the Terms & Conditions of the sale on the day of the order.
If necessary, especially if he wishes to have a gift delivered, he also indicates the name of the recipient and the place of delivery.
After having made and validated his order, the Customer checks the details and the total price of this order which he can confirm or modify in the event of an error. As soon as he confirms the order, it is definitively placed and binds the Customer. An order number is then assigned to him, which he must imperatively keep.
The Customer has the obligation to pay the amount displayed at the end of the verification process, as well as the delivery costs.
The Customer receives an acknowledgment of receipt summarising his order by e-mail. The Customer acknowledges that this e-mail, whose information is taken from the registration of his order, is proof of the nature of the agreement and its date.
The order is not definitively taken into account by L'Agri O Conso until full payment of the amount invoiced for the order.
L'Agri O Conso reserves the right to cancel or suspend an order placed on the Site if it reasonably believes that the person who placed the order has violated one of the Terms & Conditions of Sale or if there is, with the Customer, a dispute relating to the payment of a previous order. L'Agri O Conso also reserves the right to prohibit access to the Site to persons whom it reasonably believes have violated one of the Terms & Conditions of Sale.

4. Deliveries

It will be up to the customer to make himself available for the delivery window which will be specified by the seller on the delivery day chosen by the customer. By his signature, the customer certifies that he has recovered his order from the delivery person. If the customer is not available for the desired delivery day when he has paid the price of his order, the produce will be lost and then be discarded.

After order confirmation, L'Agri O Conso undertakes to deliver the produce to its customer at the address indicated on the day chosen (except for major bad weather).

The delivery is made in the time slot given by L'Agri O Conso by the direct delivery of the product to the announced recipient, or in the event of absence, to another person authorised by the customer. Any delays do not entitle the buyer to claim damages.

We invite you to be very precise when filling in the address field: door code, intercom, backyard, floor, locality.

Do not hesitate to add in the comment box all the information that can help the delivery person to accomplish his mission. Your phone is also a great help for the delivery person who uses it when he can't find you.

5.1 Withdrawal

The customer has a right of withdrawal of twenty four (24) hours to cancel his order.


5.2 Return

In the event of damage or non-conformity of the products received, the buyer has the right of return under the conditions provided for below. Always check your order upon arrival. You have a period of three (3) hours to make any reservations with L'Agri O Conso in the event of missing products or degradation (by degradation we mean very damaged products and unfit for consumption).

6. Price

All product offers on the Site are subject to available stocks.
The prices appearing on the Site are indicated in Euros ( € ), excluding shipping costs and are subject to change during the year. The products ordered on the Site show the price of the day when the order is registered.

The prices take into account the VAT applicable on the day of the order. If the rate were to be modified, these changes could be applied on to the price of the items without the Customer being informed beforehand.

7. Payment

The price charged to the customer is the price indicated on the order confirmation sent by L'Agri O Conso.

The order validated by the customer will only be considered effective when the bank payment centers concerned have given their agreement (for payments by credit card). In case of refusal of the said centers, the order will be automatically canceled and the customer notified immediately. Furthermore, L'Agri O Conso reserves the right to refuse any order from a customer with whom there is a dispute.

The Site is equipped with a secure online payment solution. The card numbers and the validity date of the card are instantly encrypted using the SSL (Secure Socket Layer) protocol and never pass unencrypted on the site, which ensures the security of the information transmitted. L'Agri O Conso has no access to these details and therefore does not store them on its servers.

8. Disputes

This contract is subject to French law. L'Agri O Conso cannot be held liable for damages of any kind, whether material, immaterial or bodily, which may result from the misuse of the products marketed. The responsibility of L'Agri O Conso will, in any event, be limited to the amount of the order and cannot be blamed for simple errors or omissions which may have remained despite all the precautions taken in the presentation of the products. In the event of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution, in particular with the help of:

A professional association in the sector, a consumer association or any other council of its choice. It is recalled that the search for an amicable solution does not interrupt the "short time" of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that as a general rule and subject to the judgment of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honors his financial commitments to the seller.

Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer will first contact the company to obtain an amicable solution.


9.1 Liability

The Customer must be aware of the precautions for use before using the Products and comply with them. L'Agri O Conso cannot be held responsible for damage caused by misuse of one of the Products or by non-compliance with precautions for use and hygiene and storage conditions.
L'Agri O Conso cannot be held liable in any way whatsoever for breach of contract in the following cases

– in the event of inaccuracy of the information provided on the Site;
– in the event of a technical problem preventing access to the Site;
– in the event of intrusion or the presence of a computer virus on the Site;
– in the event of out of stock or unavailability of a product offered on the Site;
– in the event of disruption or total or partial strike, in particular of postal services and means of transport and/or communication;
– in the event of force majeure;
– in the event of delay or damage in the delivery of the products ordered when these are due to a fault on the part of the Customer, to an unforeseeable and insurmountable fact of a third party to the contract, or to a case of force majeure;
– in the event of physical damage caused to the Customer as a result of the use of the products ordered via the Site when this damage is due to a fault on the part of the Customer, to an unforeseeable and insurmountable fact of a third party to the contract, or to a case of force majeure;

9.2 Guarantee

L'Agri O Conso guarantees that all selected products are produced at L'Agri O Conso.


10. Legal information

The collect of personal information for the purposes of internet selling is mandatory.

The lack of information leads to the non-validation of the order. In accordance with the “Data Processing, Data Files and Individual Liberties” law, the processing of personal information relating to customers has been declared to the National Commission for Computing and Freedoms (CNIL). The customer has (article 34 of the law of January 6, 1978) a right to access, modify, rectify and delete data concerning him, which he can exercise with L'Agri O Conso. In addition, L'Agri O Conso undertakes not to communicate, free of charge or with consideration, the contact details of its customers to a third party.
